Trying to Buy an Airey Property, Help!
Hi,
I am currently in the process of trying to buy my Housing Association property, which has already had the work done to it to make it non defective. This work was carried out in 1995, but nobody has proof to say that the work was completed. A retrospective PRC certificate will cost me around £1000 to get the house signed off. What my question is, if anybody is able to help is, Do the Housing Association have an obligation to provide this paperwork? THey say it was carried out by the previous owners 'Eastleigh Council' so they don't have to provide it. My other question is if I stayed a tennant would they have an obligation to prove the work was carried out to prove the house is still not in a defective state? Any help or advice greatly appreciated,

Firstly stay away from alot of companies that advertise prc repairs as i can offer advise to stop you being ripped off. With no certificate you can still buy off the housing association, the problem you'll get is when you try to sell it. Ring up Eastleigh council and ask for help, the certificate has to be kept for a number of years and you have the right to access this information under THE FREEDOM OF INFORMATION ACT. If you need a mortgage you can get one but it will be at a lot higher rate. If your stuck pay the £1000 as this will save you money in the long run. Please be aware ther are various licensed repairs.

I was just thinking if there's no proof of a prc repair then you could argue that the property has not had a licensed repair as you cannot obtain the relevant paperwork. So in my opionion the property is not worth full market value and so you should only pay the defective value for the property. Also if houses near you have been repaired the same time as yours talk to your neighbours especially the older ones as these are a mine of information. Also research Eastleigh council in 1995 and see what was spent on what this gives you a starting point, look into the accounts. Chances are this was not repaied to a license it may well have had a shaw repair or another repair. IT MUST BE A LICENSED REPAIR AND YOU NEED THE PRC CERTIFICATE. If you have time research as much as you can.I've been fighting my council for nearly 5 years now and still getting nowhere.

Thanks again for the reply. I knew who carried out the work but because it was back in 1995 the company also don't have copies of the certificates and hence the £1k to re do a survey and provide a retrospective certificate, but you'd think it should be the Housing Associations responsibility to cover this as it is their property which they are selling, allbeit via my Right to Buy. In a normal house sale you have to provide all threpaperwork for any alterations etc. Letter to the Cheif excec and my MP next might be my next course of acton, plus as you say dig around on the internet. Cheers again.

I bought mine with the right to buy in 1988 and used their solicitor for ease and was sold the house unknowing it was defective. Has my local MP onto it with no results. Sent a letter to the housing minister in London who said go back to your local council. Speak to my local council and they tell me they don't own any airey houses but they own 8. Spoke to the ombudsman about being misold sold the property. He said that i had'nt incured any financial loss so that's it. Try to find out the plans the council has for them. BUT HEY PRESTO. They won't tell me. Cannot find their asset management strategy plan. These houses are in fuel poverty and always have been. They must be brought upto the decent homes standard by 2014. This is thermal efficiency / windows / kitchen / bathroom and some councils have a grant available for this upto 27K so have a dig and see what you can uncover. BILL / DON'T GIVE UP
